AN 1 - The title comes from Yogi Berra famous baseball player
AN 2 - The story is set in between parts of Retrial and the Dr. McCool parts of the 4% solution. With a conversation from a Whole New Ball Game at the end. I’m not sure of the conversion from Eastern Daylight to Zulu time so I used Eastern Daylight.

Lt. Commander Bud Roberts approached Commander Rabb with hesitation as he sat eating his lunch. “Commander, May I join you? “Bud asked. “Sure sit down Bud,” replied the Commander. “Sir, I don’t mean any disrespect toward the Col. MacKenzie, but have you noticed her behavior recently? “ “What do you mean Bud? “ “ Well, Sir, she’s been overly aggressive in Court toward my client and the charges aren’t that severe. And she’s been very tense and short with people I haven’t seen her like this since she was being stalked several years ago.” Hum, the Commander said , has he had a flashback to the pre trail preparation of the CPO Sevelas about 7 years ago when Maj. Mackenzie had shown up drunk right after Dalton’s death. “Bud” said the Commander, “she has a lot going on right now that I’m not at liberty to share with you, but I will watch and see if I notice anything. It’s 1300 and both of us are do back in court so we better get going.”

Mac knocks on the door looking to talk to Harm about her problems sleeping since they found Webb alive and had been attacked by Simon Tanveer. Harm answered the door and they made small talk until the timer in the kitchen went off and Alicia Montes called saying that the meal was ready. Harm invites Mac in but she says no thinking that Harm had an evening planned with the lovely Professor. I’ll talk to you tomorrow says harm as she leaves. When he goes inside, Rachel Hanna comes out of the bathroom. “Professor, Rachel I asked you here this evening to discuss how you think we can overcome the set back we were handed in court today when the chain of custody of the shirt was compromised and the bombshell of you being Seaman Wainwright daughter. Dinner’s ready so let’s eat. “ The three discussed the case while they are eating. After a while Harm became silent as he has a flashback to a moment 6 years earlier, when Mac came to him when she was troubled about the arrival in Washington of her husband, he had Congresswoman Latham over for dinner and didn’t have time to listen to Mac’s problem Mac’s trial for the murder of her husband was a result of not being there for his best friend. “Commander, Harm, HARM! “says the Professor loudly , “are we keeping you from someone?” She had seen the Lt. Col. at the door and was introduced to her briefly at the office the other day. “Sorry” says Harm “I think we have the strategy all worked out. Can I get you ladies anything else.” After coffee and dessert the women left and Harm worked on his court presentation, thinking often I have to talk to Mac tomorrow. She had some definite things to say about sharing the other day when we were discussing her case. I told her, I would always be here for her and didn’t have time to listen today.

Lt. Col. Sarah Mackenzie had finished discussing the plea with Lt. Commander Roberts and the Warrant Officer Renfield who had 4 wives. She returned to the office and packed up her briefcase with paperwork for her next case as she would work on it at home this evening after her check up at Bethesda. After she dropped her things off at her apartment she headed to Bethesda with a quick stop at the Georgetown Law Library to research an idea she had while driving home. While she was there, she over her several law students talking about a Professor who was all excited about a certain military lawyer. The students didn’t mention any names but Mac assumed it was Alicia Montes and Harm.

Commander Rabb and Seaman Wainwright stood at attention when the verdict of not guilty was read. Harm was elated beating Sturgis in the case was very satisfying and long with believing that Seaman Wainwright finally received justice even if it was late because a prosecutor who was looking to make a name for himself. Harm accepted the congratulation from Seaman Wainwright and Alicia Montes but his mind was elsewhere. There was finally time to have that conversation with Mac. Both of them had been busy with their cases this morning and he hadn’t had time to talk with her. He would find her and talk to her this time unlike the time 6 years ago when he let her get away with out talking to him when Bobbi had called at the office. He went to her office and the door was closed and the lights were off. Bud was in his office so they has settled their case. Harm checked with the administrative assistant to find out that Mac had left for the day. He went back to his office and became working on his next case.

Mac was finished with her check up and she and Dr. were talking and she was going to talk to her about not sleeping the Dr. was called out for a medical emergency. Mac started to leave the Bethesda but then remembered that Dr. McCool had her offices there. Mac was hoping that she could quickly get her to write a prescription for something to help her sleep at night. Dr. McCool didn’t write the prescription right away but involved Mac in a long conversation even to the point that she canceled going to her daughter recital. Mac hadn’t realized how long they had been talking until she looked out the window and saw the sky changing colors as the sun began to set.
Mac and Dr. McCool walked out of the hospital and Mac was talking about leaving the lights on that night instead of sitting in the dark. On the way home, Mac decided to stop and get something to eat and changed out of her uniform in the bathroom of the restaurant..

Mac knocked on the door of Harm’s apartment. This was the hardest thing she had ever done. If Professor Montes was there she would know that she had pushed Harm away one to many times. “I’ve been calling you for several hours Mac. I told you we would talk today but when I finished in court you had left.” “What was the verdict, Harm” Mac asked “I thought you would be celebrating with Alicia Montes.” “It was not guilty Mac and the only person I want to celebrate with is you.” Harm answered. Come on in Mac . Mac came in and sat down “ What did you need to talk to me about last night Mac? It must have been important for you to come to my place. You left early today, did you have to go to the doctors? Is something wrong? “ Harm started in right way, he was not going to let Mac get away with not having this conversation. Mac started by talking about what she had overhead at the Georgetown Law Library that day. Harm answered “ I appreciate your concern for my safety. You can stay here and protect me from the Professor but don't you think you'd be better off going home and getting a good night's sleep?” “I wouldn't be able to sleep if I was home. I seldom do.” answered Mac. That’s part of what I wanted to talk to you about last night.” Harm pulled Mac close. “You had no problem sleeping next to me in Afghanistan when we were stranded in country” he said “ why don’t you just talk to me and relax. Slowly Mac’s answers to Harm’s questions were further apart until she had fallen asleep. Harm held her as she slept the night away, her first sound night sleep since she had gone to Paraguay on Webb’s wild goose chase.

“Good Morning Col. You look well rested” said Bud Roberts as Mac walked into the office. “I finally got a good night’s sleep. “ Mac replied. As he approached the two of them Harm thought to himself, Bud if you only know where she got her good night sleep, you would be on the phone to Harriet, but that is something we won’t share with you until we figure out where this is going.
PO Coates came up to them and harm and Mac had to go to Commander Turner’s temporary office to get their next assignment.
